This agreement legally binds customer and Warren Disposal to the conditions here with-in and in accordance with the laws of the State of North Carolina in effect at the time of placing a dumpster rental order. Warren Disposal agrees to provide customer with non-hazardous solid waste collection, transportation, disposal and recycling services.
Customer agrees to call Warren Disposal at (828)548-3867 to give Warren Disposal at least one business day notice for service (dumpster delivery, exchange, pickup, or relocation). If customer calls on a Friday, the next business day will be Monday, unless that Monday is a holiday. There may be times when a delay could be incurred in servicing customer needs due to inclement weather, traffic conditions, landfill or transfer station delays, et cetera.
If a Warren Disposal truck driver has to wait for the customer to move vehicles, remove material from an overloaded dumpster, clear an area for delivery, remove material placed in front of a dumpster, wait for a customer to unlock a gate or any other reason that causes a delay for the Warren Disposal driver, the customer will receive a $3 per minute Wait Charge.
If Warren Disposal attempts to deliver or pick up a dumpster and the dumpster is blocked, or a gate is locked or prevented in any way from delivering or picking up a dumpster, the customer will incur a $150 to $250 No Service Fee.
Customer agrees not to put any hazardous or toxic waste in the dumpster as it is against the law. All hazardous or toxic waste found in the dumpster will become the responsibility of the customer. At Warren Disposal’s discretion, Warren Disposal may return the hazardous or toxic waste found in the dumpster and charge the customer a $150 to $250 Return Fee. At Warren Disposal’s discretion, Warren Disposal may charge customer a disposal fee for the hazardous or toxic waste in the dumpster. Hazardous or toxic waste includes industrial waste, waste containing asbestos, septic tanks and waste, paint, cleaning solutions, biomedical waste, pesticides, solvents, automobiles, automobile parts, tires, oil, oil filters, oil containers, gas cans, propane tanks, batteries of any kind, appliances with Freon (air conditioners, refrigerators, etc.), Freon aerosol cans, foam aerosol cans, electronics (TV’s, computers, monitors, computer parts, radios, etc.), telephone poles, railroad ties and household garbage (food garbage).
At Warren Disposal’s discretion, Warren Disposal may charge customer, and customer agrees to pay, a disposal fee for the hazardous or toxic waste found in the dumpster as follows:
Car or Truck Tires - $50 each
Mattress or Box Spring - $100 each
Florescent Bulbs - $25 each
Paint Cans with Paint - $20 each
Car Batteries - $40 each
Propane Tanks $50 each
Oil Cans - $25 each
Freon Aerosol Cans - $100 each
A/C Compressors $200 each
Window A/C $200 each
TV’s, Computers, Monitors - $25 each
Any Small Electronic Equipment - $25 each
Vacuum Cleaner - $50 each
Refrigerator (large) - $200 each
Refrigerator (small) - $100 each
Any Other Large Appliance - $50 each
All equipment furnished by Warren Disposal shall remain the property of Warren Disposal; however, customer shall have care, custody, and control of the equipment and shall bare responsibility and liability for all loss and/or damage to the equipment and for its contents while at customer location. Customer shall not move or alter the equipment and shall use the equipment only for its intended purpose. Customer shall provide unobstructed access to the equipment on the scheduled pick-up day. Warren Disposal is NOT responsible for any damage to customer’s property, including walkways, curbing, pavement, driveways, pavers, irrigation, wells, septic or underground utilities resulting from the company’s provision of services. Customer warrants that the right of way is sufficient to bare the weight and physical dimensions of the Warren Disposal equipment and vehicles. Customer understands that lawn damage may occur during a construction and/or clean-up project. No repair is offered or provided.
Customer agrees not to over-fill the dumpster beyond the “Max Load” indicator painted on the top rail of the dumpster. An over-filled dumpster may allow debris to fall out and cause mayhem and is against the law to transport said over-filled dumpster. Warren Disposal reserves the right to refuse to pick up an over-filled dumpster. If over-filled, the customer will be responsible for removing over-filled debris down the “Max-Load” line. An additional No Service fee of $150-$250 will be applied in this case.
Warren Disposal reserves the right to refuse to pick up a dumpster with an estimated weight in excess of 24,000 pounds (12 tons). If overweight, the customer will be responsible for removing debris down below the 24,000-pound threshold. An additional $150-$250 No Service fee to the customer will be applied in this case.
Each dumpster rental includes a complementary 7-day rental time period at no cost to the customer. After the complementary 7-day period, a rental fee of $2.50 per day will then take effect if customer has not called for a dumpster exchange or final pick-up by that time. If customer calls for a dumpster exchange before the 7-day complementary rental period has expired, the new dumpster will come with another 7-day complementary rental period.
The customer agrees to indemnify, defend, and save Warren Disposal harmless from and against any and all liability which Warren Disposal may be responsible for, or pay out, as a result of bodily injuries (including death), property damage or any violation or alleged violation of the law to the extent cause by customer’s breach of this Agreement or by any negligent omission or willful misconduct of the customer or its employees, agents, or contractors in the performance of this agreement. Neither party shall be liable to the other for consequential, incidental, or punitive damages arising out of or in connection with the performance or non-performance of this Agreement.
